2011 Nob Hill Market Rules
Please review the following rules before submitting your 2011 application for the Nob Hill Growers' Market.
1. In order to participate in the Nob Hill Growers' Market, a vendor must provide copies of all pertinent state and local licenses and permits on or before opening day, May 26, 2011. Vendors must retain copies of their licenses and permits at their booths, ready for review either by market management or by respective license or permit inspectors.
2. By signing and submitting the attached application and agreement, the vendor agrees to accept full responsibility for his/her sales and to comply with the rules of the market and all applicable city, county, and state laws, ordinances, and regulations.
3. The vendor participation fee for the full 2011 season is $200, if paid in full on or before opening day, May 26, 2011. This is a discounted fee and will reserve a space for the vendor's booth. The weekly participation fee is $15 per week, collected before the close of the market day. Market management cannot guarantee a reserved space for vendors who choose to pay on a weekly basis.
4. Any vendor missing two markets at any time during the season may be suspended from participation in the market for the remainder of the season. The market manager may consider exceptions to this rule, on a case by case basis, given special circumstances. Seasonal fees will be prorated and refunded only if sufficient market funds are available. Fees required by the City of Albuquerque and other governmental and regulatory agencies are nonrefundable.
5. Spaces will be assigned based on participation and consistency. Space sizes will be determined according to space available. Spaces will not be held past 30 minutes before opening time of the market. The market manager has the final say with regard to space utilization and assignments. The vendor agrees to abide by the final decisions of the market manager for the good of the market and in accordance with the facility requirements.
6. Any vendor who is dismissed or disqualified at any other market or disqualified from participation in WIC/FMNEP may also be prohibited from participation in the Nob Hill Growers' Market, at the discretion of the market manager.
7. Vendors will not be permitted to begin sales before market opening for all vendors, 3:00 pm. Market set-up may not begin before 2:00 pm. Any tents or canopies must be made of fire-resistant material. Tents cannot be staked. Sandbags or other weights are suggested for securing set-ups. Market tear down will begin immediately after posted market closing, 6:30 pm.
8. Vendors are expected to keep the area around their booth clean and in good condition. Vendors are required to clean up their space after market closes at 6:30 pm.
9. The grass at the park must be protected from excessive foot traffic. A mat, rug, cardboard, or other covering of adequate size is required to protect the grass in the area where vendors stand behind a table. A ground cover is also required over any area in front of the table or booth where customers must step off the sidewalk to view or pay for the vendor's product.
10. Table coverings are the choice of the vendors. Remember, the more attractive and clean your booth appears, the more customers you will draw to your booth.
11. Signage, identifying your farm and identifying your produce, is strongly encouraged. Vendors are not, however, permitted to put up special discount signs. The management reserves the right to remove any questionable merchandise, materials, or signs. Carnival barking or shouted advertisement is not permitted. Dumping of produce and undercutting are not permitted and will result in the immediate revocation of the right to sell at the market.
12. Any vendors selling produce by the pound must have a NMDA certified scale. The NMDA can be contacted at (505) 646-1616. Inspection is free.
13. Vendors are permitted to sell items listed in their initial application and approved by the market manager. Vendors wishing to sell items not listed in the initial application may do so only with prior approval of the market manager.
14. Genetically modified crops or processed foods made with genetically modified ingredients are strictly banned at the Nob Hill Growers' Market and may not be offered for sale or as samples or promoted in any way.
15. The market manager has complete authority to interpret and implement policy on the market site. In all matters regarding market safety and viability, the market management has the final say.
